This document is an electronic record in terms of the Information Technology Act, 2000 and rules made there under as applicable and the amended provisions pertaining to electronic records in various status as amended by the Information Technology Act, 2000. This electronic record is generated by a computer system and does not require any physical or digital signatures.

This Agreement for the Terms and Conditions (hereinafter referred to as ‘Agreement’) of the Company’s website/mobile application (collectively referred to as “Systems”) describes certain terms and conditions to access and use the Systems of the Company and wherever the context so requires "You" or "User" shall mean any natural or legal person who has agreed to become a buyer on Systems by providing data while registering on our Systems as Registered User. The term "Company”, “Brilldaddy”, We", "Us", "Our" shall mean Brilldaddy E-commerce Private Limited and its affiliates. Please also review Our Privacy Policy, which governs the collection, use, and protection of your personal data (available on our website).

ACCEPTANCE OF TERMS OF USE:

PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY. BY ACCESSING OUR SYSTEMS, YOU AGREE TO BE BOUND BY THE TERMS AND CONDITIONS BELOW. WE RESERVE THE RIGHT TO ALTER, AMEND AND MODIFY THESE TERMS AND CONDITIONS AT OUR SOLE DISCRETION. ALL AMENDMENTS AND MODIFICATIONS WILL BE DULY NOTIFIED ON OUR SYSTEMS. IF YOU DO NOT AGREE TO THE TERMS AND CONDITIONS, WE REQUEST YOU NOT TO ACCESS THIS WEBSITE.

USER ACCOUNT & SECURITY

  1. Any customer willing to use Our Systems may create an account by providing true, accurate and complete information as to name, address, email, and phone number.

We rely on the information You have provided to Us at the time of creating an account for verifying Your details and further for delivery purposes and communication of any attractive offers from time to time.

  1. You will, at all times, be responsible for maintaining the confidentiality of Your user name and password and be responsible for all activities that occur in Your account.
  2. You agree that if You provide any information that is untrue, inaccurate or incomplete, You shall be solely responsible for the consequences thereof and We shall have the right to indefinitely suspend or terminate or block Your access on Our Systems.

Please note that Your mobile phone number and your email address is Your primary identifier on our Systems and hence it is Your responsibility to keep them updated on our Systems at all times.

USER CONDUCT:

By accessing Our Systems, You agree to :

  1. Use the Systems solely for lawful purposes and in full compliance with the Agreement, as well as applicable laws, regulations, and generally accepted professional standards.
  2. Not attempt to access the Systems using any methods other than those provided by Us. This includes, but is not limited to, using automated or unethical means to gain access to the Systems, such as data scraping tools or other unauthorized methods.
  3. Not to engage in any activity that disrupts or interferes with the proper functioning of the Systems, its servers or any associated infrastructure supporting the Systems.
  4. Not attempt to copy or duplicate the information available on the Systems.
  5. Not impersonate any individual or entity, including Our employees or representatives.
  6. Not extract, compile, or misuse data from Our Systems.
  7. Not engage in fraudulent activities, including but not limited to fake payment verification, misuse of discounts, unauthorized returns, and excessive refund requests. You further agree not to submit, upload, or share any content that is unlawful, threatening, defamatory, abusive, harassing, or discriminatory in nature. You also agree not to submit any content that infringes upon the intellectual property rights of others, including but not limited to copyrights, trademarks, or patents

A user may be considered fraudulent or a business risk if they:

  1. Ignore payment verification requests.
  2. Fail to provide required payment documents.
  3. Misuse another user’s contact details.
  4. Use false or invalid information.
  5. Exploit voucher codes or unauthorized discounts.
  6. Return incorrect items or refuse payment.
  7. Engage in theft or fraudulent claims.
  8. Have excessive returns or repeated false compensation requests.

You may only use Our Systems for purchasing Our Products or services. Unauthorized commercial use is prohibited. Users must not:

  1. Extract or compile data without permission.
  2. Misuse the Site for spam, fraud, or impersonation.
  3. Bypass security measures or disrupt operations.
  4. Abuse support services or submit false reports.
  5. Harass others or spread harmful content.
  6. Upload malware, tracking tools, or excessive spam.
  7. Damage Our reputation or violate any laws.

We reserve the right to modify, discontinue, or limit the availability of any product or service without prior notice.

RETURNS, REFUNDS & CANCELLATIONS

  1. The domain name www.brilldaddy.com is controlled, owned and operated by Brilldaddy E-commerce Pvt. Ltd.,
  2. All material on this site, including images, illustrations, audio clips, and video clips, are protected by copyrights, trademarks, and other intellectual property rights, owned and controlled by Brilldaddy E-commerce Pvt. Ltd., and are protected by intellectual property laws under the applicable laws of India.
  3. Material on Our Systems, operated, licensed or controlled by Brilldaddy E-commerce Pvt. Ltd. is solely for Your personal, non-commercial use. You must not copy, reproduce, republish, upload, post, transmit or distribute such material in any way, including by email or other electronic means and whether directly or indirectly and You must not assist any other person to do so. Without the prior written consent of Brilldaddy E-commerce Pvt. Ltd., modification of the materials, use of the materials on any other web site or networked computer environment or use of the materials for any purpose other than personal, non-commercial use is a violation of the copyrights, trademarks and other proprietary rights and is prohibited. Any use for which You receive any remuneration, whether in money or otherwise, is a commercial use for the purposes of this clause.

COMMUNICATION:

  1. We may send You communication, notices or alerts from time to time. These alerts and communication will be sent automatically by Us to You. Please be informed that You have agreed to receive any type of communication including but not limited to emails, SMS, phone calls or any other mode of communication from Us that is transactional, promotional & informational in nature.
  2. In case You have suppressed the receipt or disabled or marked alerts or communication in general, We recommend You revise the same and activate the receipt of alerts. As such any communication from Our end will be related to Our products and services and not any spam mails.

PAYMENTS:

For customers within India, the prices stated for the Products are inclusive of GST and shipping charges, (please refer to Our shipping policy). Issuance of vouchers shall not attract GST; GST shall be levied only at the time of redemption of vouchers against the underlying product/service.

The customer can make the payment either by – (i) online payment using net banking, debit/credit cards through Our payment gateway partner.* For this purpose We may enter into agreements with third party payment gateway aggregators and financial institutions authorised by the Reserve Bank of India for collection, refund and remittance and to facilitate payment or (ii) a direct payment to Us via bank transfer/NEFT.

(*Payment gateway partners are subject to change and will be notified accordingly).

Please note that We will not assume any liability or responsibility for any loss or damage incurred by You due to:

  1. Lack of authorisation for any transaction/s, or
  2. Exceeding the preset limit set by the Bank/s. or
  3. Any payment issues arising out of the transaction, or
  4. Decline of transaction for any other reason/s.

Further, for transactions made in India through electronics payments, refund shall be made through payment facility using NEFT / RTGS or any other online banking / electronic funds transfer system approved by Reserve Bank of India (RBI). We may request additional documents from You for verifications and all refunds are conditional and with recourse available to Us. We reserve the right to refuse or cancel orders due to suspected fraud, unauthorised transactions, pricing errors, or stock unavailability.

DISCLAIMER:

THE CONTENT AND ALL SERVICES ASSOCIATED WITH OUR SYSTEMS ARE PROVIDED TO YOU ON AN “AS-IS” AND “AS AVAILABLE” BASIS. WE MAKE NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, AS TO THE CONTENT OR OPERATION OF OUR SYSTEMS. YOU EXPRESSLY AGREE THAT YOUR USE OF THE SERVICE AND PURCHASE OF THE PRODUCTS IS AT YOUR SOLE RISK.

INDEMNITY AND LIMITATION OF LIABILITY:

You shall defend, indemnify and hold harmless the Company and its officers, directors, shareholders, and employees, from and against all loss, damages, claims and expenses, including but not limited to attorney’s fees, in whole or in part arising out of or attributable to any breach of this Agreement by You, any misrepresentation or misuse of the service offered to You or any negligent or unreasonable or inappropriate use of our Systems or Your violation of the rights of a third party, including but not limited to intellectual property rights or Your violation of privacy Policy. This Clause survives termination of this Agreement.

WE SHALL IN NO EVENT BE RESPONSIBLE OR LIABLE TO YOU OR TO ANY THIRD PARTY, WHETHER IN CONTRACT, WARRANTY, TORT (INCLUDING NEGLIGENCE) OR OTHERWISE, FOR ANY INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, EXEMPLARY, LIQUIDATED OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFIT, REVENUE OR BUSINESS, BUSINESS INTERRUPTION, LOSS OF PROGRAMS OR INFORMATION, OR LOSS OF SAVINGS, OR ANY OTHER DAMAGES ARISING - IN ANY WAY, SHAPE OR FORM - OUT OF THE AVAILABILITY, USE, RELIANCE ON, OR INABILITY TO UTILIZE THE SERVICE ARISING IN WHOLE OR IN PART FROM YOUR ACCESS TO THIS WEBSITE, YOUR USE OF THE SERVICE, YOUR PURCHASE OF PRODUCTS THROUGH THE WEBSITE OR THIS AGREEMENT.

TERMINATION:

This Agreement may be terminated as mentioned below: (a) by You, by providing a written notice of at least 5 (five ) business days; (b) closure of Your account by Us or You for any reason immediately; (c) We may terminate this Agreement and Your account with Us shall cease to exist if We learn that You have breached any of these terms and conditions, whether intentionally or by implication or used any false e-mail address or use Our System for any unlawful and fraudulent purposes; (d) We may terminate the Agreement, it is so required by an express direction of law.

Jurisdiction and Governing Law:

This Agreement shall be governed by the laws of India. The courts in Bangalore shall have the sole jurisdiction regarding the subject matter of this Agreement.

COUPONS, OFFERS AND EVENTS:

Coupons and vouchers:

  1. Users may redeem Brilldaddy-issued vouchers for purchases of Brilldaddy listed Products on our Systems.
  2. Vouchers hold the same face value as printed on it for redemption when purchasing Products listed on our Systems.
  3. We are committed to complying with applicable laws and regulations relating to the prevention of money laundering, terrorist financing, and other illegal financial activities under the Prevention of Money Laundering Act, 2002 (PMLA) and allied laws. We reserve the right to conduct Know Your Customer (KYC) checks, including the collection and verification of identity, address, and payment details, for any user who engages in transactions or redemptions exceeding thresholds as may be defined by Us from time to time or as may be required by law.
  4. All vouchers issued shall be valid for a period of 365 days from the date of issuance. The voucher value shall be credited as an equivalent amount in the user’s wallet on Our Systems. Such wallet amounts, vouchers are non-transferable, non-refundable, non-exchangeable for cash, and cannot be withdrawn and shall not be carried forward beyond the 365-day validity period. Users must redeem the wallet amount by purchasing Products available on Our Systems within the specified validity period. Please note that any attempt to convert them into cash or transfer them to other users may result in immediate suspension of account and legal reporting under applicable AML regulations.
  5. We reserve the right to monitor and report any suspicious transactions or patterns of behavior to the appropriate regulatory authorities and to restrict or suspend accounts that we believe may be involved in unlawful activity, without notice or liability.
  6. You agree to cooperate with Us for any investigation or audit related to AML compliance and confirm that Your participation in any promotional event or purchase is solely for lawful personal use.

OFFERS AND DISCOUNTS:

Discounts and promotions apply only as specified at the time of purchase. Brilldaddy reserves the right to modify or withdraw offers at any time without prior notice.

EVENTS:

  1. Brilldaddy events are protected by relevant intellectual property laws. Our events are free promotional events organized by Brilldaddy for its users. Participation does not involve any fee or wagering of money. The vouchers allocated under Our promotional events are intended solely for marketing and reward purposes, and may be redeemed against specified products on Our Systems, subject to applicable terms of redemption. This promotional event does not constitute wagering, betting, lottery, or online money gaming within the meaning of applicable Indian laws.
  2. These events serve as official Brilldaddy brand promotion campaigns.
  3. Participation is open to all Indian citizens over 18 years of age.

17.1 Eligibility Criteria: Participants must:

  1. Register a Brilldaddy account.
  2. Complete KYC verification.
  3. Non-eligible Individuals:
  4. Brilldaddy employees, technical associates, and their immediate family/friends.

17.2 Participation in Promotional Events:

  1. Users can enter events after successful registration of account with Us.
  2. Multiple entries are allowed per event, for free byuse of vouchers.

17.3 Promotional Events :        

  1. Each users is required to submit a numerical price
  2. The objective is to submit a unique amount that no other participant has selected
  3. Unique figures, the single lowest one among them shall be considered the winning entry
  4. Offered values must be in whole numbers.
  5. Vouchers may be redeemed against specified products on the platform, subject to availability and applicable terms of redemption

17.4 Winner Selection

  1. Winners will be identified based on single lowest unique amount as determined by us. The winner of the event shall receive the product or services associated with the specific promotional event.

17.5 Winner Announcement & Notifications :

  1. The winner will be notified via SMS, Email & or Whatsapp and winning entry will be published across our systems

17.6 Event postponement or Cancellation:

  1. If no Unique single lowest amount is received during an event cycle, brilldaddy reserves the right to postpone the event to a later date, which will be communicated to all participants. In such cases prior participants may re-enter the postponed event.
  2. Voucher eligibility will be determined through an automatic system in accordance with the pre-defined voucher program terms. Brilldaddy reserves the right to validate entries and allocate vouchers accordingly.
  3. Any statutory taxes (including but not limited to Income Tax or Gift Tax) shall be borne by the voucher recipient, if applicable

Event Tracking

  1. Users can track their voucher details in the My Account Menu (My Vouchers or Your Attempt section) on Our Systems.

Brilldaddy’s Rights:

  1. Brilldaddy reserves the right to cancel or modify any event at its discretion.
  2. Events are conducted in compliance with applicable laws and regulations.

Legal Protection & Compliance:

  1. Any unauthorized reproduction of Brilldaddy events is strictly prohibited.
  2. Legal action shall be initiated against any individual or entity attempting to replicate the event format, without prior authorization from Us.

Compliance:

  1. The Brilldaddy voucher mechanism is a promotional and reward-based system designed to allow users to obtain vouchers that may be redeemed against specific products offered on the platform.
  2. Actual product colours may differs from images due to lighting effects.
  3. Gifts products ship with In 15 working days
  4. Vouchers are not transferable for cash or cash equivalent. They are strictly redeemable against specified products, subject to terms of redemption
  5. GST Applicability: In accordance with the CGST Act, 2017 and CBIC Circular No. 243/37/2024-GST, issuance or trading of vouchers is not a supply of goods or services and shall not attract GST. GST shall be applied only on the underlying supply of goods and/or services at the time of redemption of vouchers. Any distribution commission/fee payable to agents/distributors shall be subject to GST at applicable rates. No GST shall be payable on unredeemed vouchers.
  6. Any other statutory taxes (including but not limited to Income Tax or Gift Tax) shall be borne solely by the voucher recipient.
